The lawsuit details an incident on August 26, 2015, at Catch NYC & Rooftop Bar, where Foxx was allegedly present along with his friend Mark Birnbaum, who is also named in the suit.

According to the lawsuit, the plaintiff, identified as “Jane Doe,” arrived at the rooftop bar with a friend around 11:00 pm and noticed Foxx seated at a nearby table. Despite a crowd being moved away, Jane Doe and her friend were not asked to leave. The plaintiff’s friend requested to take some photos, and Foxx, reportedly appearing intoxicated, made several comments to Jane Doe, including compliments about her appearance and likening her to Gabrielle Union.

Foxx is then accused of grabbing Jane Doe by the arm and pulling her to a secluded area of the bar, where he allegedly touched her breasts and genitals without her consent. The assault allegedly ceased when Jane Doe’s friend arrived at the scene. As a result of the incident, Jane Doe claims to suffer from post-traumatic stress disorder and lasting psychological trauma, seeking damages exceeding the monetary limits of lower courts along with punitive damages.

In response, Foxx vehemently denied the allegations through his spokesman, asserting that the incident never occurred. Foxx’s spokesperson highlighted that a similar lawsuit was filed in Brooklyn in 2020, which was subsequently dismissed. Foxx intends to seek redress for malicious prosecution against the plaintiff and her legal representatives for re-filing what he deems a baseless claim.
